• 2. Content representation and warranties

  You represent and warrant that:

  1. you are the sole author and owner of the intellectual property rights contained in any Content;
  2. all Content that you post is relevant and accurate (where it states facts) and genuinely held (where it states an opinion);
  3. f you submit your Beauty Loop level as part of your review, it is accurate based on the email address associated with the review and your Beauty Loop profile;
  4. if applicable to your review, you will disclose the following when asked on the review form prior to submitting a review:
     • if your review is submitted as part of a promotion, that your review is being submitted as part of a promotion; or
     • if you received the product that is the subject of the review for free or as part of a promotion, that you received the product for free or as part of a promotion;
  5. you understand you are participating in a public forum and that your Content will be available to others;
  6. you are at least 16 years old, or if you are a minor, that you have obtained the consent of your parent or legal guardian to submit the Content and agree to these Terms and
  7. use of the Content you supply does not violate these Terms and will not cause any damage, loss or injury to anyone.

• 3. Content rules

  You must not submit any Content:

  1. that includes inappropriate or violent language, profanities or racist or sexual slurs;
  2. that is known by you to be false, inaccurate or misleading;
  3. that infringes any third party's copyright, patent, trade mark, trade secret or other proprietary rights or rights of publicity or privacy;
  4. that violates any law, statute, ordinance or regulation (including those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
  5. that includes unsupported health or therapeutic claims, medical information or medical advice;
  6. that relates to a legal claim; that is, or may reasonably be considered to be, obscene, aggressive, inappropriate, defamatory, libelous, hateful, racially or religiously biased, offensive, unlawfully threatening or unlawfully harassing to anyone;
  7. for which you were compensated or granted any consideration by any third party;
  8. that is likely to harass, upset, embarrass, alarm or annoy any other person; that impersonates any person, or misrepresents your identity or affiliation with any person;
  9. that includes any information that references names, addresses, email addresses, contact information, phone numbers or other personally identifiable information in respect of any individual;
  10. that mentions other websites, companies, businesses or persons;
  11. that does not relate specifically to the product, including delivery or availability of a product, careers or customer service;
  12. that is not in English;
  13. that relates to a product you have not used;
  14. that contains, or may be reasonably considered to contain, excessive random characters or false or meaningless word strings;
  15. that has been duplicated in multiple reviews; or
  16. that contains any computer viruses, worms or other potentially damaging computer programs or files.

• 4. Content licence

  1. For any Content that you submit, you grant MECCA a worldwide, perpetual, irrevocable, royalty-free, transferable and sub-licensable right and licence to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from, sell, or distribute such Content (and all intellectual property rights contained therein) without compensation to you or anyone else. This licence includes the right for MECCA to incorporate such Content into any form, medium or technology throughout the world. This licence will survive the termination of these Terms and your use of the MECCA website.
  2. In relation to any moral rights you may have in respect of the Content, you:
     • consent to MECCA doing any of the following:
       • not attributing the author of any copyright works or subject matter;
       • falsely attributing authorship of any copyright works or subject matter; and
       • subjecting the copyright works or subject matter to treatment that would, without the author's consent, infringe the author's rights in the Copyright Act 1988 (Cth), the UK Copyright, Designs and Patents Act 1988 or any equivalent law of any jurisdiction; and
     • waive these rights, to the extent legally possible, for the benefit of MECCA (and its affiliates, partners, subsidiaries, related bodies corporate and licensors).

• 5. Confidentiality

  You acknowledge and agree that:

  1. none of the Content that you submit is confidential;
  2. the Content that you submit will not be subject to any obligation of confidence or other restriction on use and publication on the part of MECCA, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees (Relevant Parties); and
  3. MECCA and the Relevant Parties will have full and unimpeded authority and ability to publish, communicate, use and disseminate the Content in any manner, form, medium or technology, at their sole discretion.

• 6. Indemnity and liability

  1. You agree to indemnify and hold MECCA and the Relevant Parties harmless from all claims, demands, costs and damages of every kind and nature, known and unknown including legal fees, arising out of a breach of these Terms, a breach of your representations and warranties set out above, your violation of any law (including advertising and consumer protection laws) or the rights of a third party, or any regulatory investigation, proceeding, penalty or complaint in connection with the Content you submit.
  2. To the extent permitted by law, MECCA and the Relevant Parties hereby expressly exclude any liability for any indirect or consequential loss or damage incurred by any user in connection with the Content including any liability for loss of revenue, loss or interruption of business or loss of data. MECCA expressly excludes liability for any loss or damage arising from the use of any Content submissions or the CRR Service by any person in contravention of these Terms.

• 7. Disclaimers

  1. You further acknowledge and agree that:
     • although Content may be moderated by MECCA, it is under no obligation to anyone to oversee, monitor or moderate the Content and it may stop doing so at any time; 
     • MECCA and its designees will have the right (but not the obligation) in their sole discretion to pre-screen, reject, change, condense or delete any content on the MECCA websites (including the Content) that MECCA deems, in its sole discretion, to violate its content guidelines or any other provision of these Terms, or is otherwise objectionable;
     • MECCA reserves the right to edit, remove or to refuse to post any submission of the Content or part thereof for any reason, including to ensure compliance with relevant laws, regulations and codes;
     • you, not MECCA, are solely responsible for the contents of the submitted Content (whether edited by MECCA or not);
     • MECCA will try to publish as many Content submissions as possible but it does not guarantee that all Content submissions will be published;
     • MECCA does not guarantee that you will be able to edit or delete any Content you have submitted;
     • ratings and written comments (based on your Content) are generally posted within two to four business days, but this is only an estimate and MECCA cannot guarantee how quickly Content will be posted; and
     • by submitting your email address in connection with your Content, you agree that MECCA and its third party service providers may use your email address to contact you about the status of your review and other administrative and marketing purposes. MECCA respects the importance of privacy and directs you to our Privacy Policy for further information.
  2. Some product reviews displayed on our website come from third-party sources, rather than our customers. These reviews are not verified by us and reflect the opinions of the original reviewers, not our own.
  3. The reviews displayed on our website are for general information purposes only and to help you make informed decisions. They reflect the opinions of individual reviewers and do not represent our views or endorsements. We do not verify the accuracy, completeness, or reliability of any reviews and are not responsible for their content. Reviews do not constitute professional advice or a guarantee of product performance.
  4. Beauty Loop levels submitted as part of the CRR Service are not automated by us. MECCA reserves the right (but is not obligated) to verify the Beauty Loop levels submitted with reviews and remove any reviews (in part or in whole) that MECCA deems to violate these Terms.

• 8. Modification

  1. MECCA may revise these Terms at any time, upon notice or as required by law. You are expected to check this page from time to time to take notice of any changes made, as they are legally binding on you.
  2. If MECCA elects to modify these Terms, we will post a new version and update the date set out above. Any changes are effective immediately upon posting.
  3. You should read and carefully consider these Terms before submitting Content to MECCA as part of the CRR Service, and check back regularly for any changes.

• 9. Applicable-law

  1. These Terms are governed by the laws of Victoria, Australia.
  2. You and MECCA submit to the exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia.
